Adjacency

Private property developers, designers and contractors who are building within 200 feet of MTA property should contact the External Partner Program (EPP).

The EPP Adjacency program area reviews and approves, or provides a determination of no impact, for residential, commercial and other developments initiated by the private sector.

By reviewing and approving construction documents, the EPP Adjacency Technical team safeguards existing MTA and New York City Transit infrastructure from potential impact resulting from nearby third-party construction. Due to proximity, these projects may impact MTA structures, passengers, or operations.

Developers, property owners, contractors, or their design professionals' representatives submit projects to Adjacency for review and approval. While it strives to protect MTA infrastructure, the EPP technical team equally understands and considers the fast pace of its clients' needs and endeavors to provide services through a streamlined process considering private construction industry needs.

Submitting applications for Adjacency projects

Private property developers, designers and contractors should apply to EPP for review and approval if they are proposing construction within 200 feet of MTA structure/property before they obtain a construction permit from the NYC Department of Buildings (DOB). 

To apply:  

  1. Complete the archival request form and submit to EPP to request archival/as-built drawings for the area around your project.
  2. Check the zoning requirements. Determine whether Zoning for Accessibility or other requirements apply to your project.
  3. Use the MTA provided archival/as-built drawings as overlay on the drawings and follow the design guidelines when preparing the proposed engineering submission. Ensure EPP general notes and insurance requirements are included in the submission. Provide any related NYC DOB documentation and a clean copy of the archival/as-built drawings.
  4. Submit your application package via the EPP online platform.
